Congressional Leaders Move To Break Up the Liberal 9th Circuit Court

Well, it looks like Congress might be trying to put the brakes on the Ninth Circuit Court of Appeals.
You might remember these folks from their attempt to rule that the words “Under God” in the Pledge of Allegiance were an unconstitutional attempt at government religious establishment. Well, last week, this same court ruled that parents have no say in what material is presented to their kids at school. Including material of a sexual nature.
Today Congress has introduced a bill that will break this court’s jurisdiction into two parts. This would allow the president to appoint seven new justices.
Of course, the bill is expected to have a long, hard fight through the Senate and then each of the judges would have the same, but at least there is hope.
Also, see Jennifer Rast’s comments over at the Scriptorium. She makes some excellent points about what constitutional founders and past presidents have feared about the U.S. judiciary.

The 9th Circuit is a true embarrassment. As often as they get overruled, you'd think they'd start to consider that they might be legally ignorant! Now someone will challenge the legislation breaking up the 9th Circuit and the courts will rule it unconstitutional.
